Terms of service

There may be some things the Buyer need to know about the Seller customer policy.

The Seller lists the main points of our Terms and Conditions for the Buyer below:
A request, either orally or otherwise, by the Customer (The Buyer) to The Framers London (The Seller) to carry out the supply of goods or services constitutes acceptance, and agreement to, the following terms:
The contract shall be governed by the Laws of England Act Consumer Contracts Regulations Act 2013
These terms shall form the basis of the contract between the Seller and the Buyer in relation to the sale of goods and/or services.
Acceptance of delivery of the goods or commencement of the services shall be deemed to be conclusive evidence of acceptance of our terms and conditions.
These terms represent the whole of the agreement between the Seller and the Buyer. They supersede any conditions previously issued.
These terms apply to all orders for goods and services, including those placed online via email or phone
All prices are displayed and quoted in pounds sterling.
Quotes are valid for 30 days.

1.2) Cancellations/Returns
Our cancellations policy is as per the Consumer Contracts Regulations Act 2013.
Once an order for made to measure goods (tailor-made) has started to be manufactured it cannot be changed or cancelled for any reason whatsoever.
Made to measure goods we supply include, but are not limited to, picture frames, mounts, boards and glass.
Made to measure goods cannot be returned for a refund unless they are unfit for purpose.

1.3) Order Processing Timescales
If the Buyer need an order urgently please call us 020 7704 1667 to discuss prior to placing the order, and the Seller will do everything possible to meet the Buyer requirements.
Order processing timescales are defined as from the time the deposit/full payment in made.
The order processing time varies depending on the size of the Buyer order and general demand. Timescales are not guaranteed, but the Seller always endeavour to process the Buyer order as fast as possible.
Please note that if the Buyer are ordering past 12pm, the Buyer order may not start to be processed until the next working day. 

1.4) Timescales
Whilst every effort will be made to meet the estimated timescales for a given order timescales are not guaranteed and the Seller accept no liability or consequential loss for either delays to or non-delivery of the Buyer order.
Please note that delayed delivery shall not be grounds for rejecting goods or terminating the contract.

1.5) Liability
The Buyer has acknowledged and agree that the Seller are only willing to provide our products and framing services if the Buyer agree that Seller liability is limited. 
Under no circumstances shall the Seller be liable for any claim made by the Buyer for consequential or economic loss or damage.
We will not, under any circumstances be liable for any consequential loss as a result of the incorrect supply, late delivery, accidental misrepresentation or any other reason whatsoever whether avoidable or not.
The Seller reserves the right to appoint a sub-contractor without notice in respect of all or any of the Goods and or Services to be supplied under the Contract and the Seller shall have no liability to the Buyer arising out of and or in connection with the supply of any goods and or services by the said sub-contractor. 
The Seller has worked hard to ensure the website and specifications are up to date, however the risk of error remains; where the buyer do identify a mistake, or it is brought to the attention the Seller will rectify it as soon as possible.
Colours of frames, mouldings and mounts viewed via photos may appear different shades on different monitors, tablets, phones and laptops. Where the exact colour and finish is vital please note that you can order moulding and mount samples in person in our shop.

1.6) Payment and Interest
All orders must be paid for in full before they can be collected or dispatched. Deposit/full amount must be paid before any work commences. 
The Buyer shall pay all accounts in full and not exercise any right of set-off or counter claim against invoices submitted by the Seller.

1.7) Title and Risk
Risk shall pass on either collection from the Seller premises or the delivery arranged by seller of the goods to the Buyer's address.
Notwithstanding the earlier passing of risk, title in the goods shall remain with the seller and shall not pass to the Buyer until the amount due under the invoice for them has been paid in full.

1.8) Collection
The Seller ask that completed orders are collected within 2 weeks. 
Upon collection the Buyer shall inspect and examine the goods/services supplied. Collection by the Buyer shall be deemed to be acceptance that they are satisfactory and meet expectations. 
The Seller shall not be responsible for the quality or fitness of the Goods for any purpose and collection by the Buyer shall be deemed to be acceptance of them and that they are in accordance with the terms of the Contract.

1.9.1) Storage of Uncollected Orders
The Seller would appreciate it if the Buyer could collect your completed order once it is ready since we have limited storage space and therefore we reserve the right to charge a storage fee of £1.00 per day on orders that are uncollected after 30 days.
1.9.2) Storage of Uncollected Large Orders
If the Buyer have an uncollected large item, please get in touch to arrange collection. Please note that for uncollected larger framed items, these may have to go into commercial storage at a different location, all transport and associated storage fees will be invoiced and payable when the Buyer do collect. If the Buyer uncollected order has gone into storage please note the Seller will need 1 week's notice when the Buyer intend to collect.
1.9.3) Disposing of Uncollected Framed Artwork
If framed artworks remain uncollected, after 30 days, the Seller will write to the Buyer (via recorded email) in order to:
    •    Remind the Buyer that the order needs to be collected.
    •    Confirm any outstanding balance.
    •    Notify that the Buyer reserve the right to charge a storage fee of £1.00 on uncollected orders after 30 days.
    •    Notify that if not collected within a further 30 days the Seller reserve the right to dispose of or sell the Buyer artwork to create space and recover funds owed to the Buyer.
    •    If disposing of the artwork raises any funds, from those funds we will take the money owed to the Seller, plus storage and handling charges.

1.10) Deposited Items
Upon acceptance of Deposited Items for whatever purpose the Seller shall issue to the Buyer a receipt which must be produced by the Buyer upon any claim being made in accordance with these conditions by the Buyer against the Seller for damage suffered to the Deposited Items.
1.10.1) The Seller shall not be liable and accepts no responsibility for any loss, theft or damage to the Deposited Items or any part thereof and gives no warranty or guarantee that the Services shall not cause damage to the Deposited Items. 
1.10.2) The Buyer acknowledges that the Seller has not affected any insurance whatsoever in relation to the Deposited Items and agrees that any insurance in respect of the Deposited Items is its sole and exclusive responsibility.

1.11) Force Majeure
The Seller shall not be liable for delay or failure to perform any obligation under these terms & conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to and acts of god, war, civil disorder , industrial dispute, hindering or delaying deliveries from suppliers, shippers or sub-contractors, or otherwise affecting or hindering the fulfilment of the Contract by the Seller or any circumstances whatsoever outside their control, the Seller shall have the option either to cancel the Contract or to extend the time of completion delivery or collection during the period as the circumstances or any of them or their after effects shall continue. In the event of any such cancellation by the Seller, or any extension of time, the Buyer shall have no claims whatsoever against the Seller. 

1.11) Data Protection
We will only use the information we collect about the Buyer lawfully (in accordance with the Data Protection Act 2018). The Buyer may email the Seller to check the information the Seller hold about the Buyer at any time.
